LHC bars college from collecting unapproved fee
 Lahore :October 08: The Lahore High Court Chief Justice on Monday barred Shaikh Zayed Medical & Dental College from collecting unapproved annual fee of Rs.475,000 from the students and directed it to receive Rs.365,000 from each student in line with decision made by the Board of Governors in 2009.
Chief Justice Umar Ata Bandial passed the order while disposing of a petition moved by General Secretary Pakistan Medical Association (PMA), Lahore, Dr Tanvir through Advocate Noshab A. Khan.
In its order, the court directed the Punjab government to constitute new Board of Governors of the public sector entity within three months. However, till constitution of the BoG, no adjustment or refund will be made to the students, the order said.
The court observed that it was the responsibility of the provincial government to loot into the affairs of the institutions or departments devolved under 18th amendment in the constitution.
The court further observed that the SKZMC was charging excessive Rs110, 000 (Rs75, 000 as tuition fees and Rs35, 000 as admission fee) from each student since 2009 without the approval of the BoG, terming it illegal.
The court ordered SKZMC to charge annual fee from the students as per decision of the then BoG in 2009 (Rs365, 000) instead of unapproved fee (Rs475, 000) annual.
The court order said the SKZMC had failed to justify the increased amount of the fee and to produce any document showing its approval from the competent authority.


The SKZMC would refund or payback the fees to the students if the BoG had not been constituted, the court order added.


Earlier, advancing arguments on behalf of the PMA, Advocate Noshab contended that SZMC was the only public sector institution which was collecting fee from its students equal to private colleges despite getting considerable funds from the government. He said the SZMC was handed over to the Punjab government on February 14, 2012 under devolution policy after the 18th constitutional amendment.


The counsel pointed out that the institution continued to charge exorbitant fee from the students without approval of the competent authority. The lawyer requested the court to issue directions to the administration of the respondent college to develop their fee structure at par with public sector medical colleges in the province.


Opposing the petition, the law officer of the SKZMC argued that all expenses of the college were being met from the fees received from the students as no grant had been received from the government.
